Millay not guilty of unlawful sexual contact

On February 12, a Hancock County jury found Jerome Millay of Blue Hill not guilty on charges of three counts of unlawful sexual contact with a female less than 18 years of age.

According to court documents, Millay was “the parent, step parent, foster parent, guardian or other similar person responsible for the long-term general care and welfare” of the accuser who was a minor at the time of the incidents in 2000 and 2001. The alleged contact took place in Blue Hill and in Surry. Millay was indicted by the Hancock County grand jury last October.

Assistant District Attorney Mary Kellett said, in the week after the trial, “Besides the testimony of the victim, four witnesses testified that Jerome Millay admitted to them, in 2002, that he had acted in an inappropriate and sexualized way towards the victim. Mr. Millay testified. He denied touching the victim and he denied his admissions to the witnesses.”

On February 16, Millay wrote in a release to the press, which he said was approved by his attorney, “Although not called to testify by the State, when called by the Defense to testify, the District Attorney’s investigator Det. Stephen McFarland’s testimony confirmed that important details in the sworn statements given to him by several witnesses [during his investigation] in July 2009 had changed significantly during their testimony at the trial. During deliberations the jury requested a read-back of Det. McFarland’s testimony, after which they quickly returned verdicts of not guilty on all charges.”

Millay said that he has “missed his children terribly during this long and difficult separation.” He looks forward to renewing his role as father and friend to them now that the State is satisfied that he deserves this privilege. Millay further said, “I’m very relieved that my right as a parent has been fully restored and am hopeful that my sons and I will be able to quickly mend the damage that has been caused by our separation during this process.”
